Termination of Employment

Sometimes, employers need to make difficult decisions in business, and one of the toughest is deciding to let someone go. It is even harder when that decision affects a group of workers.

The Canada Labour Code outlines the procedures employers must follow when acting on these decisions to ensure individuals are given ample notice of their pending termination or appropriate compensation for a lack of notice. In the case of group terminations, employers must also provide workers with an opportunity to review the situation, brainstorm possible alternatives and, if none can be found, ease the transition process from their current jobs to alternative employment.

  • Find out about the rules that govern the process of a notice of termination from both the employer and employee perspectives.
  • A group termination involves more than 50 workers at a time: employers are required to notify several key players at least 16 weeks before the terminations take effect. Most employers must also establish a committee to develop an adjustment program.
