Continuous Operations

Due to the nature of their work, continuous operations cannot shut down for weekends and holidays or keep normal, Monday to Friday business hours. Special legal provisions therefore accommodate these operations because they must run continuously.

A continuous operation is any:

  • industrial establishment where, in each seven-day period, work continues without stopping until regularly-scheduled operations are completed for that period;
  • operation or service involved in running trains, planes, ships, trucks and other vehicles, whether scheduled or not;
  • telephone, radio, television, telegraph, communications or broadcasting operation or service; and
  • operation or service normally carried on without regard for Sundays or public holidays.

Not all employees working in these industries are subject to continuous operation provisions. In a trucking company, for example, office staff are usually not required to work outside of normal business hours and, therefore, are not subject to these provisions.
