1. Purpose
To establish procedures for forwarding claims to the appropriate provincial compensation authority.
2. Policy
Workers' compensation for occupational injuries and diseases is an employee's right, not a privilege, and it is the responsibility of the employer and Labour Canada to protect this right.
3. Procedure
The employer shall fully complete the appropriate provincial form for all injuries involving medical attention or lost time, and forward it to Labour Canada within established provincial time limits.
4. Responsibilities
4.1 Labour Canada shall:
- certify eligibility under the Act;
- check claims for accuracy and completeness;
- determine method of income payment;
- decide if an election under the Act is required;
- insert alpha and numeric codes where required;
- countersign and forward the claim to the appropriate provincial compensation authority.
4.2 The employer shall:
- establish and disseminate appropriate instructions for injuries or industrial disease;
- ensure that the appropriate compensation forms are completed and forwared expeditiously to Labour Canada;
- not delay a claim while investigating an accident, or for any other reason;
- complete and forward any subsequently required forms to Labour Canada.
