
The Merchant Seamen Compensation Board consists of three members who are appointed by the Governor in Council pursuant to the Merchant Seamen Compensation Act. The Board reports to the federal Minister of Labour who has the overall responsibility for the Act.
The Board hears and decides claims arising under the Act. The Act provides benefits to merchant seamen who are injured or disabled as a result of their work. Benefits are for loss of earnings and the cost of medical aid.
Merchant Seamen who are injured while their ship is on a "Hometrade" or "Foreign" voyage, as defined in the terms of the Canada Shipping Act, are entitled to benefits. Fishermen and pilots and those entitled to claim under provincial Workers' Compensation Acts are not entitled to benefits under the Merchant Seamen Compensation Act.
Employers are liable to pay benefits awarded and the administrative expenses of the Board. They must maintain insurance against the risk of claims and report all accidents to the Board.
